Terms of Service

1. Parties and Scope
These Terms of Service apply to all agreements between Ostheimer OG (Fabriksgasse 20, 2230 Gänserndorf, Austria; VAT ID: ATU79912016; hereinafter "qr3.app" or "we") and users of the qr3.app SaaS platform (hereinafter "Customer").
2. Service Description
qr3.app provides a cloud-based QR code platform as Software-as-a-Service (SaaS), including a REST API, dashboard, CLI, SDKs, and EU Digital Product Passport functionality. The service runs on Cloudflare's global infrastructure.
3. Plans and Pricing
- Free: €0/month — 10 QR codes/day, 500 scans/month
- Pro: €29/month — 100 QR codes/day, 10,000 scans/month
- Business: €79/month — 500 QR codes/day, 100,000 scans/month
- Agency: €199/month — unlimited QR codes, 1M scans/month
All prices are exclusive of applicable taxes.
4. Payment and Billing
Paid plans are billed monthly in advance via Stripe. In case of payment failure, we reserve the right to suspend or terminate access to the service.
5. Cancellation
Paid subscriptions can be cancelled at any time via the customer portal (Stripe). Cancellation takes effect at the end of the current billing period. The Free plan has no contract commitment.
6. Right of Withdrawal (Consumers)
Consumers have a 14-day right of withdrawal from the date of contract formation. The right of withdrawal expires if the service has been fully rendered before the end of the withdrawal period and the consumer has explicitly agreed to this.
7. Acceptable Use
Customers may only use the service for lawful purposes. Prohibited uses include:
- Creating QR codes pointing to phishing, malware, or fraudulent sites
- API abuse (DoS, unauthorized scraping)
- Reselling access credentials
- Any activity violating applicable law
Violations may result in immediate account suspension or termination without notice.
8. Privacy
Data processing is governed by our Privacy Policy. A Data Processing Agreement (DPA) is available upon request for business customers.
9. Availability and SLA
We target 99.9% uptime per year (SLA guaranteed for Agency plan only). Free and Pro plans have no guaranteed SLA. Planned maintenance is announced 24h in advance.
10. Limitation of Liability
Our liability is limited to intent and gross negligence, except for injuries to life, body, and health. Liability for indirect or consequential damages is excluded to the extent permitted by law. Total liability is limited to the fees paid in the last calendar month.
11. Changes to Terms
We reserve the right to modify these Terms with 30 days' prior notice via email. If the Customer does not object within 30 days, the new Terms are deemed accepted.
12. Governing Law and Jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Jurisdiction is Gänserndorf, Austria, to the extent permitted by law. For consumers, statutory jurisdiction applies.
